Licensing & Change-of-Use Planning (Childcare)

Context

Childcare projects in existing buildings often require Licensing & Change-of-Use Planning before design work can begin. A short, structured assessment can determine whether a space can support a licensed program under both Ministry of Education requirements and the Ontario Building Code (OBC). This is especially important for change‑of‑use scenarios, first‑time operators, and spaces within commercial or community buildings where existing conditions may limit what is possible.

When This Service Is Needed

Licensing & Change-of-Use Planning is recommended when:

  • A location is being considered but not yet secured
  • The project involves a change of use from a non‑childcare occupancy
  • The layout or floor area may not support the required classroom sizes
  • Daylighting, exits, washrooms, or accessibility are uncertain
  • Operators need clarity before proceeding to lease, purchase, or full design

Licensing & Change-of-Use Planning determines whether the project should proceed, be adjusted, or be avoided before committing significant resources.

What The Review Typically Covers

Licensing & Change-of-Use Planning focuses on Ministry licensing and building code viability based on measurable requirements:

  • Required floor area for each age group
  • Window‑to‑floor area ratios and daylighting
  • Exit access, travel distance, and life‑safety requirements
  • Fire separations and required ratings
  • Barrier‑free washroom and fixture requirements
  • Relationship to outdoor play areas, fencing, and site access
  • Base‑building limitations affecting mechanical, plumbing, or structure
  • Key upgrades triggered by change of use

The result is a clear picture of what is feasible, what is mandatory, and what would require corrective work.

Existing Conditions

Potential outcomes are shaped by the existing conditions of a site:

  • Prescriptive Ministry and OBC standards
  • Existing construction that may limit configuration
  • Availability of daylight, plumbing, exits, and accessible routes
  • Building systems that may not support increased occupant loads
  • Site conditions affecting outdoor play and safe access

Licensing & Change-of-Use Planning allows clients to make informed decisions early, reducing the risk of committing to a site that cannot obtain approvals.

Typical Outcomes

Licensing & Change-of-Use Planning offers a recommended professional opinion:

  1. The space can support the intended program; or,
  2. The space is viable, but only with specific modifications; or,
  3. The space cannot be licensed due to core building limitations.

Documentation is provided to support:

  • Lease or purchase decisions
  • Early conversations with authorities
  • Budgeting and project planning

Licensing & Change-of-Use Planning is typically the first step before committing to design fees, leasing, or construction. It identifies site constraints early, clarifies scope, and lowers the risk of licensing setbacks later in the project.
